Gigapixel AI provides browser-based AI-powered image processing tools, including but not limited to:

  • Image Upscaler: AI-powered resolution enhancement up to 8× original size.
  • Background Remover: Automated background removal with transparent PNG output.
  • Image Blender: Image composition and blending with multiple professional modes.

All Services are provided free of charge and are accessible without account registration. The Services are provided “as is” and “as available” without warranties of any kind, either express or implied.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including the availability of any feature, database, or content, without prior notice or liability.

3. User Conduct and Responsibilities

When using our Services, you agree that you will not:

  • Use the Services for any illegal purpose or in violation of any local, state, national, or international law.
  • Upload, process, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Upload images that contain child sexual abuse material (CSAM) or exploit minors in any way.
  • Infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any third party.
  • Upload images containing malware, viruses, or other harmful code.
  • Attempt to gain unauthorized access to any portion of the Site, Services, or related systems or networks.
  • Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Use the Services to generate content for deceptive, fraudulent, or misleading purposes, including deepfakes intended to deceive.
  • Reverse engineer, decompile, or disassemble any aspect of the Services.
  • Exceed reasonable usage limits or engage in activity that places an unreasonable load on our infrastructure.

Content Moderation: We reserve the right to monitor, review, and remove any uploaded content that violates these Terms. We may also report illegal content to appropriate law enforcement authorities. We do not actively monitor all uploads but will take action upon becoming aware of violations.

4. Intellectual Property

4.1 Your Content

You retain all ownership rights to the images you upload to our Services. By uploading images, you grant us a limited, non-exclusive, royalty-free license solely for the purpose of processing your images through our AI tools and delivering the results back to you.

As stated in our Privacy Policy, we do not store your uploaded images after processing is complete. All images are automatically and permanently deleted from our servers immediately after processing.

4.2 Output Images

All processed output images generated through our Services belong to you. You are granted a worldwide, perpetual, royalty-free license to use, reproduce, modify, distribute, and display the output images for any purpose, including commercial use, without attribution to Gigapixel AI.

4.3 Our Intellectual Property

The Site, Services, and all content, features, and functionality thereof — including but not limited to text, graphics, logos, icons, images, audio clips, software, algorithms, and the compilation and arrangement thereof — are owned by Gigapixel AI or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as necessary for your personal, non-commercial use of the Services.

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of information as described in the Privacy Policy.

  • Your access to or use of, or inability to access or use, the Services.
  • Any conduct or content of any third party on the Services.
  • Any content obtained from the Services.
  • Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT OF ONE HUNDRED US DOLLARS (USD $100.00) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

8. Indemnification

You agree to defend, indemnify, and hold harmless Gigapixel AI and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms.
  • Your use of the Services, including but not limited to your content and any use of the Services’ content, services, and products other than as expressly authorized in these Terms.
  • Your violation of any rights of another party, including intellectual property rights.
  • Your violation of any applicable laws, rules, or regulations.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in the United States. You agree to submit to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Gigapixel AI regarding the Services and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.

13. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Gigapixel AI.
